1. Acceptance of Terms

Welcome to CLOSETCHER. These Terms of Service ("Terms") govern your access to and use of the CLOSETCHER mobile application, website, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use our Services. We reserve the right to modify these Terms at any time, and your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old to use CLOSETCHER. If you are under 18, you represent that you have your parent or guardian's permission to use the Services. By using CLOSETCHER, you represent and warrant that:

• You meet the age requirements stated above
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• You have not been previously suspended or removed from the Services

3. User Accounts

3.1 Account Creation

To use certain features of CLOSETCHER, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

3.2 Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we deem harmful to other users or the Services.

4. User Content

4.1 Your Content

You retain ownership of all content you upload to CLOSETCHER, including photos, descriptions, and other materials ("User Content"). By uploading User Content, you grant CLOSETCHER a worldwide, non-exclusive, royalty-free license to:

• Store, display, and process your User Content to provide the Services
• Use AI and machine learning to analyze your clothing items and generate outfit suggestions
• Display your User Content to friends and other users you choose to share with
• Create derivative works (such as cropped or resized images) as necessary for the Services

4.2 Content Standards

You agree that your User Content will not:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Contain hate speech, harassment, or discriminatory content
• Include sexually explicit, violent, or graphic content
• Promote illegal activities or harmful behavior
• Contain spam, malware, or malicious code
• Impersonate others or misrepresent your identity

4.3 Content Moderation

We reserve the right (but have no obligation) to review, monitor, and remove User Content that violates these Terms or is otherwise objectionable. We may use automated tools and human review to enforce our content standards.

5. Intellectual Property

5.1 CLOSETCHER Property

The Services, including all software, designs, text, graphics, logos, and other content (excluding User Content), are owned by CLOSETCHER and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the Services
• Reverse engineer, decompile, or disassemble any software
• Remove or alter any copyright, trademark, or proprietary notices
• Use our trademarks or branding without written permission

5.2 Feedback

If you provide feedback, suggestions, or ideas about the Services, you grant us the right to use such feedback without any obligation to compensate you.

6. Prohibited Conduct

You agree not to:

• Use the Services for any illegal purpose or in violation of any laws
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the Services or other users' accounts
• Interfere with or disrupt the Services or servers
• Use automated scripts, bots, or scrapers to access the Services
• Collect or harvest personal information about other users
• Sell, rent, or commercialize access to the Services
• Create multiple accounts to evade bans or restrictions
• Engage in any activity that could damage our reputation or business

7. Social Features

7.1 Friend Connections

CLOSETCHER allows you to connect with friends, share closets, and borrow items. You are responsible for your interactions with other users. We are not responsible for disputes between users.

7.2 Borrowing & Lending

The borrowing feature facilitates connections between users but does not create any contractual relationship between CLOSETCHER and users regarding borrowed items. All borrowing arrangements are between users, and CLOSETCHER is not responsible for:

• Lost, damaged, or stolen items
• Disputes over borrowed items
• Return of borrowed items
• Quality or condition of items

8. AI Features

CLOSETCHER uses artificial intelligence to analyze clothing items and generate outfit suggestions. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You acknowledge that:

• AI suggestions are for informational purposes only
• We do not guarantee the accuracy of AI-generated content
• You should verify AI-generated information before relying on it
• AI features may improve over time as we refine our models

9. Disclaimers

9.1 Service "As Is"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee

We do not guarantee that the Services will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any aspect of the Services at any time without notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOSETCHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Services
• Any bugs, viruses, or other harmful code transmitted through the Services
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Services
• User Content or the defamatory, offensive, or illegal conduct of any third party

11. Indemnification

You agree to indemnify, defend, and hold harmless CLOSETCHER, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Services
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

12.2 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@closetcher.com. We'll try to resolve the dispute informally by contacting you via email.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Services. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.

14. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CLOSETCHER regarding the Services.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
